CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 3090 of 2012 In the matter of : Sri Tarun Kumar Mondal ....petitioner. In Re : An application under Section 397 read with Sections 399,401 and 482 of the Code of Criminal Procedure. The revisional application was preferred in respect of the orders dated 15.05.2012 and 26.06.2012 passed bvy the learned District Magistrate, Barasat(Sadar), 24 Parganas North in connection M. P. Case No. 92 of 2012 filed under Section 147 of the Code of Criminal Procedure.
Record of this revisional application reflects that the matter appeared on 05.09.2012 before a co-ordinate Bench of this court and it is reflected that none appeared on behalf of the petitioner to pursue the revisional application. Today, when the matter is taken up, no one appeared on behalf of the petitioner.
Having regard to the fact that more than 9 years have expired since the order has been passed by the concerned District Magistrate, I am of the view that it will cause prejudice to either of the parties if interference is made at this belated stage.
Accordingly, the present revisional application being CRR 3090 of 2012 is dismissed.
All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
