This is a contempt proceeding arising from an order dated July 9, 2024 passed by this Court. Rule was issued in the matter on February 14, 2025. Pursuant to the Rule the alleged contemnor for the Pradhan of the concerned Panchayat Smt. Anuradha Gayen is present personally before this court today. Mr. Ayan Banerjee, learned counsel appearing for the alleged contemnor submits a compliance report in the form of affidavit affirmed by the alleged contemnor on

April 10, 2024, the same is taken on record. Copy has been served upon the learned counsel for the petitioner. Mr. Fazlul Haque, learned counsel for the petitioner on instruction from his client submits that part of the direction which were required to be carried out by the Pradhan has been carried out and the direction has been complied with by the Pradhan. He submits that since Pradhan has already referred the matter before the jurisdictional Sub-Divisional Officer as also Howrah Zilla Parishad, now the steps shall have to be taken in terms of the direction of this court. Be that as it may, this contempt proceeding was initiated alleging contempt primarily against the Pradhan and since the direction has been complied with by the Pradhan, the alleged contemnor, there is no further requirement to proceed with these contemnors. The personal appearance of the alleged contemnor stands dispensed with.

Rule issued, stands discharged.

Since the order stands complied with by the Pradhan the order dated February 14, 2025 stands modified to the extent that the Pradhan shall resume her regular function as Pradhan of the concerned Panchayat with an immediate effect and the jurisdictional SubDivisional Officer who was appointed as an officer of this court and has taken charge of the administration of the

Panchayat stands released with an immediate effect, after the charge is handed over to the Pradhan. This order is restricted only in respect of the instant contempt proceeding being CPAN 1566 of 2024.

Sirsanya Bandopadhyay, learned Senior Standing Counsel with Akash Dutta, learned counsel appearing for the jurisdictional Sub-Divisional Officer files a report to show that the Sub-Divisional Officer has performed his duties in tune with the direction of this court, the report is kept on record.

Accordingly, this contempt proceeding CPAN 1566 of 2024 stands dropped and closed.

The application CPAN 1566 of 2024 stands disposed of.
