The petitioner prays for extension of his deputation at the Bureau of Civil Aviation, Netaji Subhas Chandra Bose International Airport, Kolkata. Such representation has been made on October 17, 2022.

Mr. Bhattacharya, learned counsel appearing on behalf of the petitioner, submits that his client was transferred on deputation on 2020. The petitioner's child studies in Class - I at Kendriya Vidyalaya, Ballygunge. In case she is transferred from her school without completion of one year, the same might have a psychological effect on her.

Mr. Dasgupta, learned counsel appearing on behalf of the respondents submits that the petitioner's prayer for extension was previously

considered by the Ministry of Home Affairs, Government of India.

The under Secretary, by a notification dated 16th /17th February, 2022 decided not to accord extension to the deputation tenure of the petitioner. Therefore, there is no valid reason for further consideration of his representation dated October 17, 2022.

Having considered the rival submissions of the parties and the materials placed on record, this court finds that justice will be subserved if the representation dated October 17, 2022 is considered by the respondent no.2/the Director General, Force Head Quarters, Sashastra Seema Bal (SSB), New Delhi within 6 weeks from date.

Let a reasoned order be communicated to the petitioner within 2 weeks of passing thereof. With the direction aforesaid, WPA 23251 of 2022 is disposed of.

Since no affidavits have been invited in the writ petition, all the allegations contained therein are deemed not to have been admitted by the parties. All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
