(NDPS) 1204 of 2022 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 11.10.2022 in connection with Gangarampur Police Station Case No.339 of 2020 dated 24.09.2020 under Sections 22(c)/23(c)/27A/28/29 of the NDPS Act.

And In Re: Rajjak Mia @ Rezzak Ali ... ... Petitioner Ms. Jeenia Rudra ... ... for the petitioner Mr. Sanjay Bardhan Mr. Palash Ch. Majhi ... ... for the State Report is placed on record. From the report it appears petitioner is the owner of the premises wherefrom narcotic substance above commercial quantity i.e. 300 bottles of phensedyl syrup containing codeine phosphate was recovered.

In view of the aforesaid incriminating materials and the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is thus rejected.
