In view of the fact that the petitioner's husband exercised option for conversion from CPF to GPF on 24th August, 1985 but did not refund the employer share of CPF. The petitioner's application for pension was rejected on 27th March, 2001 by the Director of School Education, Government of West Bengal and thereafter, the petitioner made a representation on 6th January, 2024, which is almost 23 years after the rejection of her request and without the husband refunding the employer share of CPF when he was alive.

We are not inclined to give any relief to the writ petitioner. The appeal fails.

Accordingly, the appeal and the application are dismissed. However, there shall be no order as to costs. (Soumen Sen, J.)
