C.R.M. (A) 4909 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in connection with Tehatta P. S. Case No.373 of 2017 dated 03.08.2017 under Sections 467/468/471/420 of the Indian Penal Code corresponding to GR Case No.779 of 2017.

Heard learned lawyers appearing for the parties. Learned lawyer for the petitioner submits that he is a typist and is in no way connected with the forgery of the document. We have considered the materials on record. Investigation is complete.

Under such circumstances, custodial interrogation of the petitioner is not necessary and he may be granted anticipatory bail. Learned lawyer for the State opposes the prayer for anticipatory bail.

However, keeping in mind the extent of complicity in the crime, we are inclined to grant anticipatory bail to him. Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting

officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that he shall appear before the trial court and pray for regular bail within a period of four weeks from date.
