I have considered the plight of the present 26.02.2025 Court No. 35 Item No.9 Rakib petitioner and the prayer in the writ petition and I have perused the Case Diary, I find that number of communications have been made by the investigating officer of the case to the bank authorities as well as the Officer-in-Charge, SOG, Sundarban Police District.

Notices have been served under Section 41A of the Code of Criminal Procedure.

Having considered that the case was initiated on 09.09.2023 and till date the investigating officer after one year five months is unable to assess regarding the persons involved in the case, I am of the view that because of lack of infrastructure it may not be possible for the investigating officer to get the results inspite of putting in best of the efforts.

Having considered the nature of the offence complained of and the manner in which the money has been transmitted it would be in the interest of justice to transfer the investigation of Mathurapur PS Case No.

225/23 dated 09.09.2023 to the Cyber Crime Police Station, CID, Bhabani Bhaban, West Bengal.

The present investigating officer would hand over the records of the case to the new investigating officer who would take the investigation to its logical conclusion. With the aforesaid observations, WPA 23704 of 2024 is disposed of.

Case Diary be returned to the learned advocate appearing for the State.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
