The petitioner have preferred an appeal before the appellate authority which is pending for disposal. Thus, the said appeal be disposed of at an early date preferably within a period of three weeks from the date of communication of this order.

The petitioner will be at liberty to produce before the appellate authority the decision of this Court on the said issue.

Thus, this writ petition is disposed of.

There shall be, however, no order as to costs.
