1. We have heard the learned counsel appearing for the parties.

2. Affidavit of service filed in court is taken on record.

In spite of service, the Managing Committee, Ahmadpur Joydurga Girls'

High School, P.O-Ahmadpur, District-Birbhum is not represented.

3. We modified the impugned order by directing the respondent no. 3, Ahmadpur Joydurga Girls' High School, P.O-Ahmadpur, District-Birbhum to consider the writ petition as a representation and dispose of the grievance of the writ petitioner in accordance with law after directing the Managing Committee of the erstwhile school to produce all relevant records in respect of the issues raised in the writ petition, namely, service book, Provident Fund Account, other records and documents of the petitioner.

4. The Managing Committee will also have the right to make appropriate submission before the authority concerned in respect of the allegations made by the writ petitioner against inaction of the said Managing Committee.

5. The entire exercise shall be carried out and completed by the respondent no. 3 positively within a period of eight weeks from the date of communication of this order. It will be the duty of the Managing Committee, Ahmadpur Joydurga Girls'

High School, P.O-Ahmadpur, DistrictBirbhum to comply with each and every direction of the respondent no. 3 with regard to the issues involved in the writ petition. The Managing Committee shall be obliged to comply with all the requisions and produce all paperes that are necessary to redress the grievance of the petitioner.

6. With the above direction, the appeal being MAT 1877 of 2023 stands disposed of.

7. In view of disposal of the appeal, nothing remains to be decided in the application for stay being CAN 1 of 2023 and the same is accordingly disposed of.

8. However, there shall be no order as to costs.

9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
