The present revisional application has been preferred challenging the order dated 02.09.2023 in Misc. Appeal No.06 of 2023 which is pending before the learned Additional District and Sessions Judge, FTC, Ranaghat, Nadia.

Having regard to the grievance expressed by the petitioners in respect of the stay order which has been passed, I am of the view that the interim order was passed by the learned appellate court as a measure prior to deciding the final appeal. Number of issues have been canvassed by the learned advocate appearing for the petitioners. At this stage when the appeal is pending before the appellate forum, I do not intend to invoke the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure. However, having regard to the factum that the parties may suffer because of pendency of the appeal, I direct the learned appellate court to dispose of the appeal by 31st December, 2023 by fixing as many dates the learned appellate court deems fit and proper in the meantime.

With the aforesaid observations, CRR 3693 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
