No observation being made on merits of the case, opposite parties shall not be prejudiced by an order passed in their absence.

The petitioner assailed the judgment delivered by the learned Judicial Magistrate, 17th Court, Calcutta in Complaint Case No. 362 of 2006 on February 16, 2024 in an appeal before the learned Chief Judge, City Sessions Court, Calcutta which was registered as Criminal Appeal No. 86 of 2024. The petitioner sought 60 days' time for depositing 20% of the fine amount before the learned Trial Court. By an order passed on August 29, 2024, the petitioner's prayer was turned down with a direction to deposit the said amount by the next date, i.e., on September 10, 2024. The petitioner seeks further extension of time to deposit the said amount.

Upon consideration of the physical condition of the petitioner as appears from the medical certificate issued in his

favour, this Court is inclined to hold that the petitioner be granted a month's time to deposit the said amount of 20% of the fine amount before the learned Trial Court. The petitioner shall deposit the said amount within February 15, 2025 and file receipt thereof before the learned Appellate Court.

The revisional application being CRR No. 4077 of 2024 is disposed of.
