The present challenge has been preferred against a decision by the Passport Authority to grant a passport to the petitioner only for a period of one year.

However, it is rightly pointed out by the learned Additional Solicitor General that the order of the jurisdictional criminal court, within the contemplation of the Office Memorandum dated October 10, 2019, which carves out an

exception to Section 6(2)(f) of the Passports Act, 1967 has not been challenged before this Court. 4.

At this juncture, learned counsel appearing for the petitioner prays for leave to withdraw the writ petition with liberty to file a fresh challenge against the order of the Magistrate.

Accordingly, W.P.A. No. 22978 of 2023 is dismissed as withdrawn with liberty to the petitioner to challenge the order of the jurisdictional Magistrate refusing the petitioner's prayer for modification of the no-objection granted to the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
