The petitioner alleges illegal and unauthorized construction at the behest of the private respondents. During the pendency of the writ petition the Bidhannagar Municipal Corporation has already conducted an inspection and hearing. The matter is, however, yet to be finally disposed of by the Bidhannagar Municipal Corporation.

Learned advocate representing the private respondents submits, upon instruction that, they are residing in the said construction for a considerable period of time. The construction in question was made during the pre-independence era. No new construction is carried on at present.

A report has been produced before this Court by the learned advocate representing the Bidhannagar Municipal Corporation.

The Corporation is directed to pass final order at the earliest but positively within a period of three weeks from the date of communication of this order and communicate the same to the parties immediately thereafter.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
