Jha ... for the petitioner The petitioner herein as complainant made a prayer for expeditious disposal of Complaint Case No.11786 of 2022 presently pending before the Court of 18th Judicial Magistrate, Calcutta. The petitioner filed aforesaid complaint case against the opposite parties under Section 200 alleging commission of offence punishable under Sections 406/420/120B of the IPC. He further submits that after receipt of summon, the petitioner obtained bail on 14.07.2025 and thereafter he did not turn up and for which the proceeding has been stalled for a considerable period of time. He further submits that a non-bailable warrant of arrest was issued against the petitioner vide order dated 1st September, 2025.
However, the Court below had not taken any further step to secure attendance of the accused persons before the Court below who are the residents of Pune, Maharashtra. In such circumstances, he prayed for a direction upon the Court below invoking this Court's jurisdiction under Section 529 of the BNSS for expeditious disposal of the proceeding.
Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the petition, opposite parties will have no cause to prejudice and as such service of copy of application upon the opposite parties is dispensed with. Having heard learned Counsel for the petitioner and that the prayer made by the petitioner is justified, the Trial Court is hereby directed to make every endeavour for expeditious disposal of the proceeding by taking further coercive step, if required, against the accused persons who are allegedly absconding and to make every endeavour to conclude the trial preferably within a period of six months from the next date of hearing.
This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
CRR 4397 of 2025 thus stands disposed of.
