1. Affidavit of service filed in Court today be retained with the records.

2. Instruction forwarded by the District Engineer & Station Manager signed on 26th September, 2024 is taken on record.

3. The petitioner alleges that despite payment of the amount quoted by WBSEDCL for obtaining new electricity connection, the same has not been provided to the petitioner.

4. Learned advocate representing the Distribution Company Limited submits, upon instruction that, the connection could not be given to the petitioner because of the objection raised by Nirmal Das, Bimal Das, Gopal Das & Bubai Das, who are the adjacent plot holders.

5. As an issue has been raised with regard to the way leave through which the electricity connection may be provided to the petitioner, accordingly, the same is required to be resolved by the concerned District Magistrate.

6. It will be open for the petitioner to apply before the District Magistrate, South 24 Parganas for resolution of the dispute

relating to the way leave for obtaining new electricity connection.

7. In the event such an application is made, the District Magistrate shall consider the same, in accordance with law after giving reasonable opportunity of hearing to all the necessary parties and by passing a reasoned order. The District Magistrate shall ensure that the dispute is resolved at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
