The appellant is not represented nor any accommodation is prayed for on behalf of the appellant. The appeal is arising out of an order of refusal to pass any ad-interim order of injunction in hire purchase matter.
We do not find any reason to interfere with the order passed by the learned Trial Judge on 15th November, 2019. We are also of the view that the appellant was not able to make out a prima facie case for an ad-interim order of injunction. We have been informed by the learned Counsel for the respondent that the suit was dismissed in the meantime.
Be that as it may, we do not find any reason to interfere with the order passed on 15th November, 2019. The appeal being FMA 1728 of 2019 and the application being CAN 1 of 2019 (Old No: CAN 10996 of 2019) stand dismissed.
However, there shall be no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
