Ct.No.28 as (Rejected) C.R.M. (DB) 3627 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Pandua P.S. Case No.35 of 2012 dated 22.02.2012 under Section 392 of the Indian Penal Code and Sections 25/27 of the Arms Act. In the matter of : Satyajit Das.

... Petitioner.

Mr. Angshuman Chakraborty.

...for the Petitioner.

Mr. Pravas Bhattacharyya, Mr. Pratick Bose.

...for the State.

Petitioner was on bail since 2012. Subsequently, he did not appear and was re-arrested in 2017. Since then, he is in custody. There is slow progress in the trial of the case. Learned Advocate for the State opposes the prayer for bail and submits trial has substantially progressed. We have considered the materials on record. Though petitioner is in custody for a protracted period of time, in view of his past conduct, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.

However, we direct the trial court to conclude the trial at an early date preferably within six months from the next date fixed for recording evidence without granting unnecessary adjournments to either of the parties.
