Mishra ... ... for the contemnors Learned counsel appearing for the applicant submits that the order dated 1st August, 2018 passed by His Lordship the Hon'ble Justice Dr. Sambuddha Chakrabarti has not been complied with as after the order was passed, the alleged contemnors did not allow the applicant to join his post despite the order dated 12th December, 2017 was set aside and quashed by His Lordship.

Learned counsel appearing for the alleged contemnors submits that as per direction by His Lordship the remaining stages of enquiry proceedings have been completed and fresh order was passed by the disciplinary authority. The fresh order was also challenged by the applicant and the writ petition is pending before this Court.

Heard learned counsel appearing for the parties.

As the order dated 1st August, 2018 has already been complied with by the alleged contemnors by way of concluding the disciplinary proceeding and passing an order on 21st January, 2018 afresh, there is no willful violation and intentional disregard to the order dated 1st August, 2018 passed by His Lordship the Hon'ble Justice Dr. Sambuddha Chakrabarti.

There shall be no order as to costs.
