Learned advocate for the petitioner submits that the Complaint Case No. AC-2005 of 2010 was instituted under the provisions of Section 138 of the N. I. Act and is pending before the learned Judicial Magistrate, 10th court, Alipore, South 24 Pgs. Learned advocate submits that till date the examination of PW-1 has not been completed.

Having considered that the present case is pending for the last 13 years, I direct the learned Judicial Magistrate, 10th court, Alipore to fix dates on each and every week so that the trial of the case can be expedited.

If the defence is not willing to cross-examine the prosecution witnesses, the learned Magistrate after granting one opportunity would close the evidence. After the examination under Section 313 of the Code of Criminal Procedure is over, two months time is to be granted to the defence to complete its witnesses, thereafter the learned trial court within a period of forty-five days after hearing

the argument would pronounce its verdict.

. With the aforesaid observations, the present revisional application being CRR 3700 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
