The petitioners have prayed for expeditious hearing of an Eviction Suit, which is pending before the learned Judge, XII Bench, City Civil Court at Calcutta.

It appears from the record that several applications namely, applications under Section 7(1) of the West Bengal Premises Tenancy Act. 1997, Section 7(2) of the said Act, an application under Order XXXIX Rule 7 as well as an application under Order XXVI Rule 9 of the Code of Civil Procedure are pending.

The learned Advocate appearing for the petitioners submits that 29.02.2024 is the date fixed for hearing of the aforesaid applications.

In view of such submission of the learned Advocate for the petitioners, CO 3384 of 2023 is disposed of by requesting the learned Judge, XII

Bench, City Civil Court at Calcutta to take up the hearing of the pending interlocutory applications in Ejectment Suit No.26 of 2022 on the next date fixed i.e. on 29.02.2024, if the same are otherwise ready for hearing and to dispose of the same as expeditiously as possible but positively on or before the month of April, 2024 without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
