The grievance of the petitioner is that the ad interim order of injunction is being extended from time to time and the hearing of the application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure is being unnecessarily delayed.

The learned Advocate for the petitioner submits that the petitioner has already filed the written objection to the application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure and the injunction application is otherwise ready for hearing.

The learned Advocate appearing for the petitioner further submits that 18.01.2024 is the date fixed for hearing of the application for injunction.

In view of such submission of the learned Advocate for the petitioner, CO 3387 of 2023 is disposed of by requesting the learned Civil Judge, Senior Division, 1st Court, Rampurhat, Birbhum to take up the hearing of the application under Order

XXXIX Rules 1 and 2 of the Code of Civil Procedure filed in connection Title Suit No.48 of 2023 on the next date fixed i.e. on 18.01.2024 and dispose of the same as expeditiously as possible but positively by end of February, 2024 without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
