Heard learned counsels for the parties.

It is not in dispute that there is dispute between the petitioners and the private respondents with regard to their status in respect of the trust in question, both the parties claiming to be trustees. The petitioners submit that the college is under lock and key which is jeopardising the future of several students studying therein. Examinations are due to commence from November 03, 2025 despite which the students are unable to enter the college. Report submitted by the State demonstrates that pursuant to the complaint lodged by the petitioners a

specific case has been started by the police and investigation is in progress.

Learned counsel for the private respondents submits that despite the dispute between the parties with regard to the trust, the college has been kept open and the students are collecting their admit cards therefrom for the ensuing examinations which shall be held on and from the schedule dates i.e. from November 03, 2025 to November 15, 2025. Learned counsel further submits that the examination or education pursuits of the students are not/shall not be affected due to the existing dispute between the parties.

However, the parties are yet to take steps before the Civil Court in terms of the earlier order passed by this Court on August 25, 2025. The earlier order also records that the police authorities have drawn up proceedings under Sections 126/135 of the BNSS in view of apprehension of breach of peace at the locality. In view of what is recorded above, keeping the writ petition pending shall not serve any fruitful purpose. The same accordingly disposed of.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

There shall be no order as to costs.

Urgent certified website copy of this order, if applied for, be given to the learned advocates for the parties on usual undertakings.
