1. Mr. Bhattacharjee, learned counsel for petitioner after arguing for sometime seeks to withdraw this PIL with the liberty to file appropriate proceedings to ventilate his self-same grievance. The other side has no objection.

2. Accordingly, PIL is dismissed as withdrawn, with the liberty, as prayed for.

3. It is, however, made clear that this Court has not expressed any opinion on merits and in the event, petitioner raises such grievance, the Court of competent jurisdiction shall decide it on its own merits.

4. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
