Petitioner is aggrieved by the fact that the private respondents being her son-in-law and daughter-in-law had been inflicting torture upon her. Learned advocate submits that inspite of criminal case pending, the private respondents are continuing to inflict torture upon the old mother. Affidavit of service so filed be kept with the record.

Learned advocate appearing for the state has submitted a report which reflects that Naihati PS Case No. 203/24 dated 19.07.2024 has been registered for investigation under sections 117(2)/351(3)/3(5) BNS, 2023.

Report so submitted be kept with the record.

It has been reported that the private respondents were granted bail by the learned ACJM, Barrackpore.

In view of the contentions raised by the petitioner, I grant liberty to the petitioner to approach the learned ACJM Barrackpore for modifying and/or varying the condition of bail. If there are allegations of torture which appears to the learned ACJM Barrackpore being inflicted upon the mother, in that case, the learned ACJM, Barrackpore will impose condition upon the respondent no. 5 to stay outside the jurisdiction of Naihati Police Station.

With the aforesaid observations WPA 23836 of 2024 is disposed of.
