This is an application filed under Section 5 of the Limitation Act, 1963 for condonation of delay of about 730 days in filing the review application. 2.
Having heard the learned Advocate appearing on behalf of the applicant as also considering the statements made in the said application, this Court is satisfied with the grounds indicated therein, as sufficiently explaining delay of 730 days in preferring the review application.

In view of the above, the application for condonation of delay being CAN 1 of 2025 is allowed and disposed of.

There will be no order as to costs.

Review is sought of an order dated 15th September, 2021 passed by a Co-ordinate Bench of
this Court in W.P.A. (H) 48 of 2021. Thereafter the matter has been assigned to this Bench.

The grounds for review urged by the applicant appearing in person are that there is an error in the said order dated 15th September, 2021 to the extent that it holds that there is no illegality on the part of the private respondent or failure on the part of the State.

It is submitted that there is an error in the order dated 15th September, 2021 that guns were used by the miscreants at the instance of the respondent/wife, to kidnap two children, who admittedly are studying in Classes XII and XI respectively. They are presently graduates.

It is further submitted that there is an illegality to the extent that fire arms were brandished by the said miscreants and two daughter of the applicant have been kidnapped from his custody.

As already considered by the original Bench indicates that there is a long standing matrimonial disputes between the applicant and the private respondent/wife. Several orders are made but not complied with.
The original order records an outstanding due of Rs.10,00,000/- (Rupees ten lakhs only) to the applicant appearing in person submits that he had paid off the said sum of Rs.10,00,000/-. 10.
Costs imposed by a Co-ordinate Bench of this Court of Rs.50,000/- (Rupees fifty thousand only) are
also stated to have been paid but no receipt has been produced before this Court.

This Court finds that two daughters, who are majors as on the date, have not chosen to appear before this Court or intervene to assert any decision to live with their father appearing in person before this Court.

Since the children are adults, they are at liberty to take an independent decision whether they want to visit their father or stay with him. The matter is entirely at the discretion of the adult daughters. 13.
This Court, therefore, finds absolutely no reason to review the order dated 15th September, 2021 passed by a Co-ordinate Bench of this Court in W.P.A. (H) 48 of 2021. Consequently, R.V.W. 311 of 2025 fails and is hereby dismissed.

In the event West Bengal State Legal Services Authority has not received the costs of Rs.50,000/-, they may take appropriate steps including approaching this Court for realizing of the same from the applicant.

There will be no order as to costs.
