Heard learned counsel for the parties.

It is submitted on behalf of the petitioner that he has been falsely implicated in this case. Though certain materials allegedly belonging to the Electricity Department has been seized from his shop, he was not aware of the mode of procurement of the said material and has only purchased them as scrap in course of his business transaction. The petitioner has no previous antecedent and shall cooperate with the investigation of the case if enlarged on bail. The petitioner is in custody since 3rd September 2022.

Considering the material on record, nature of the offence as well period of detention of the petitioner, I am inclined to hold further detention of the petitioner is not required for the purpose of investigation.

Accordingly, the petitioner namely, Abdul Mannan be released on bail upon furnishing bond of Rs.10,000/-(Rupees Ten thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Chief Judicial Magistrate, Malda subject to the condition that he shall meet the Investigating officer once a week till submission of charge-sheet. CRM(SB) 251 of 2022 is thus disposed of.
