Petitioner approached this Court as the respondent no.6, Saurabh Ghosh could not be traced out and the warrant issued by the learned Judicial Magistrate, 1st Court, Barrackpore, North Parganas in M. Ex.Case No.22 of 2017 could not be executed.

This Court earlier directed Missing Person Bureau, CID, West Bengal to take over the issue relating to tracing out of the respondent no.6. The respondent no.6 after exhaustive efforts was traced out at Chattishgarh and he was brought by way of transit remand and produced before the learned Judicial Magistrate, 1st Court, Barrackpore, North 24 Parganas. Thus, the purpose for which the writ petition was filed has been sub-served. It would be for the learned Judicial Magistrate, 1st Court,

Barrackpore, North Parganas to take the proceedings of execution case to its logical conclusion. Further pendency of the writ petition is unwarranted.

Accordingly, WPA 23873 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
