Heard learned counsels for the parties.

It is not in dispute that the plot in question is a vested land. The petitioner alleges that the private respondents who are his brothers are disturbing his peaceful possession in his share of the said land.

Disputing such fact learned counsel for the private respondents submits that the petitioner has never been in possession of any portion of the land at any point of time. It appears prima facie from the certificate issued by the Pradhan of Boyermari Gram Panchayat - I that the petitioner has been in possession of 4 decimals of land in Dag no. 802 since at least 10th January, 2020. In view of the above, the police authority is directed to render necessary assistance to the petitioner so that his peaceful possession in respect of the said portion of the land is not disturbed by the private respondents.

The police authority shall keep strict vigil over the area in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquility.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
