The present revisional application was preferred challenging the continuance of Kharagpur Local Police Station Case No.375 of 2022. The said case was relating to the subject matter of purchase of land. Subsequently compromise was entered into between the parties.

Accordingly, a report was called for. Today, a report has been submitted including the statement of the opposite party no.2/ de facto complainant. The same reflects that the opposite party no.2/de facto complainant has received the amount which according to him, was the subject matter of purchase relating to the land-in-dispute. Let the report be kept with the record. Having regard to the fact that the charges are magistrate triable and the charge-sheet is yet to be submitted, I am of the opinion that further continuance of the proceedings in the changed

circumstances may not be required because of the amicable settlement between the parties.

Accordingly, all further proceedings of Kharagpur Local Police Station Case No.375 of 2022 dated 14.05.2022 corresponding to G.R. Case No.1492 of 2022 be hereby quashed. Consequently, CRR 3705 of 2023 is allowed.

Pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
