Learned advocate appearing for the petitioner submits as follows. The petitioner is the owner of the truck by which a consignment of coal was sent from the Adani Enterprises Limited, Haldia to the private respondents. After the consignment reached to the private respondents' place, they took up a point that the coal was sub-standard and unnecessarily the petitioner's truck was not released. Although this dispute is between the consignor and the consignee. The petitioner approached the police with the complaint but no steps were taken. After this, the private respondents came up with an FIR that the consignment of coal received by the private respondents was not of the same quality that was loaded on the truck. The petitioner has already prayed for release of the truck.

Learned advocate for the State relies on the report and submits as follows. The petitioner has filed three applications before the trial court for return of vehicle.

The truck has been seized in connection with Coke Oven PS Case No.105 dated 10.07.2023.

At this stage, the petitioner submits that no seizure has been provided to the petitioner.

The investigating officer shall immediately provide a seizure list for the seized truck to the petitioner. The application for return of vehicle filed by the petitioner shall be decided by the trial court expeditiously, preferably within a period of a fortnight from date and in accordance with law.

With these observations, the writ petition is disposed of.
