Learned counsel for the petitioners submits that the private respondents are trying to dig earth for construction of a drain in front of the petitioners' house. The petitioners submitted representation before the District Magistrate, Purba Medinipur and the Block Development Officer, Egra, Block- Kudi, Purba Medinipur in this regard which has not been considered. The petitioners seek consideration of the representation and police assistance so that there is no breach of law and order.

Learned counsel for the private respondents submits that it is the petitioners who are constructing a boundary wall by covering the drain running through the government land for which there is water logging in the locality. A representation has been filed by the private respondents and other villagers before the District Magistrate, Purba Medinipur which is under consideration.

Learned counsel for the State refers to the report which prima facie supports the petitioners' case. Upon consideration of the submission made on behalf of the parties, the District Magistrate, Purba Medinipur, being the 2nd respondent herein, is directed to consider the representations submitted by the petitioners and the private respondents and others and take necessary consequential steps at the earliest upon intimation to the parties. In the meantime, the police authority shall keep strict vigil over the locality in order to avoid any untoward incident and to maintain peace and tranquility.

With the above observations and directions, this writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
