Petitioner is in custody for over 600 days. He submits there is little progress in the matter before the trial court. Learned Advocate for the State opposes the prayer for bail. He submits report.

From the report, it appears delay was caused on the score of enquiry over discharge of co-accused Beauty Mondal. Presently, the case has been committed to the Court of Sessions and date has been fixed for production and framing of charge.

In view of the aforesaid circumstances and as there is ample material which shows complicity of the petitioner in the homicidal death of his wife at his residence, we are of the view that this is not a fit case to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

We direct the trial court to consider the issue of framing of charge at the earliest and in the event charge is framed to take the proceeding to its logical conclusion without granting unnecessary adjournments to either of the parties. (Ajay Kumar Gupta,J.) (Joymalya Bagchi, J.)
