Learned advocate for the petitioner is aggrieved by the order dated 23.09.2022 passed by learned Sessions Judge, Barasat, North 24 Parganas in connection with Criminal Appeal No.74 of 2022.

Learned appellate court by the said order was pleased to reduce the interim monetary relief granted to the present petitioner.

Learned advocate submits that the quantum so reduced has created financial hardships and is not commensurate with the earnings of the husband. I find that the order which is under challenge is an interim order during the pendency of the main appeal. It has been informed that the next date has been fixed on 16th October, 2023.

Learned Special Court is directed to dispose of the appeal by 15th of December, 2023. The learned Appellate

Court would be at liberty to fix as many number of dates it deems fit and proper prior to disposal of the case on merits. With the aforesaid observation CRR 3706 of 2023 is disposed of.

All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
