Heard learned counsels for the parties.
None appears for the private respondents despite service.
Learned counsel for the petitioner submits that in a title suit filed by the petitioner against some of the private respondents, the learned Trial Court, by an order passed on 5th October, 2024 directed both the parties to maintain status quo in respect of the nature, character and possession of the said property. Despite such order, the private respondents are forcibly performing Durga Puja by encroaching upon the land of the petitioner.
It appears that a specific case has been registered on the basis of the complaint lodged by the petitioner and upon completion of investigation, charge sheet has been submitted. A counter case is also registered pursuant to
complaint lodged by the private respondents wherein also charge sheet has been submitted.
The petitioner seeks to take necessary steps before the learned Magistrate for redressal of his grievance. The issue is subjudice before the learned trial Court. However, the police authority shall keep strict vigil in the area so that there is no breach of law and order.
The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
