15.2.2022 sb CRR 3177 of 2017 (Via video conference) In the matter of : Rajoo Engineers Ltd. & Anr. .......Petitioners The present revisional application was preferred challenging the proceedings being CR Case No. 147 of 2013 pending before the learned Judicial Magistrate, 2nd Court, Siliguri under Sections 406/420/120B/34 of the Indian Penal Code.

The petitioners approached before this Court at the stage when the process was issued against the accused persons after filing the petition of complaint.

Records of this revisional application reflect that by an order dated 18.8.2017, there was an interim order for a limited period. Today, when the matter was taken up, none appears for the petitioners or for the State. No information has been furnished before this Court regarding the present stage of the proceedings of the complaint case before the learned Judicial Magistrate. I have perused the contentions advanced by the petitioners in the revisional application and I am of the opinion that the petitioners would be at liberty to agitate the points canvassed in this revisional application at the stage of consideration of charge before the learned Judicial Magistrate or at the appropriate stage of the proceedings.

No interference is called for at the preliminary stage when the petitioners approached this Court pursuant to the issuance of process.

Accordingly, the revisional application being CRR 3177 of 2017 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
