31.10.2022 Sl. No.19 akd [Rejected] C. R. M. (DB) 3667 of 2022 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 12.10.2022 in connection with Kandi Police Station Case No. 473 of 2020 dated 03.11.2020 under Sections 302/376D/34 of the Indian Penal Code.
And In Re: Nur Ali Sk. @ Nur Ali Seikh ... ... Petitioner Mr. Kallol Kumar Basu Md. Jannat-ul-Firdous Mr. Rajesh Naskar ... ... for the petitioner Mr. Joydeep Roy Mr. Amanul Islam ... ... for the State Petitioner renews his prayer for bail. It is submitted on behalf of the petitioner that co-accused is on bail. Learned advocate appearing for the State opposes the prayer for bail.
We have considered the materials on record. Petitioner had ravished the victim who ultimately died. In view of gravity of the offence and as the prayer for bail of the petitioner was rejected earlier on merits, we are not inclined to grant bail to the petitioner at this stage. The application for bail is thus rejected.
