Having regard to the time period which has passed in the meantime - which is almost 10 years, I am of the view that, at this stage, it would not be fit and proper to interfere with the liberty of the private opposite party no.2.
However, in case, the said proceeding is still surviving and/or there are supervening circumstances creating impediment in the progress of the case and/or tampering with the evidence, the petitioner would be at liberty to bring the same to the notice of the learned court in seisin of the case. The learned court would afford an audience to the parties, thereafter, exercise its discretion for furthering the cause of justice. With the aforesaid observations, CRM 10088 of 2018 is disposed of.
