Versus

The State of West Bengal & Ors.

Mr. Barnali Gupta Sk. Nizamuddin ..for the Petitioner Mr. Subhajit Roy ....for the State Affidavit of service filed by the petitioner is taken on record.

The petitioner claims to be the owner and occupier of the premises in question and alleges that the private respondent, also claiming to be the owner thereof, has encroached upon the same and is disturbing the peaceful possession of the petitioner therein.

It appears that there is a dispute of title between the parties which may be dealt with by the appropriate civil forum. The petitioner is at liberty to approach the civil court for redressal of his grievance.

In the meantime, the police authority shall keep strict vigil over the area in order to maintain of peace and tranquility.

The writ petition is disposed of.

There shall, however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
