It appears that the instant criminal revisional application is pending since 2017 for setting aside the order dated 7.1.2013 whereby the learned Judicial Magistrate, First Class 3rd Court, Ranaghat, Nadia was pleased to allow the prayer for DNA test made by the opposite party no.2 in connection with Misc. Case 168 of 2012 praying for maintenance filed by the petitioner under Section 125 of the Code of Criminal Procedure. Considering the approach of the petitioner it appears that the petitioner is not appeared before this Court on the earlier occasions. Today in first call, petitioner was absent and in the second call none appears. Except private op no.2. Considering the same it appears that the petitioner is not interested to proceed with this matter. Accordingly, the instant revisional application is dismissed for default.

Any order of stay passed by this Court during the continuation of the instant criminal revisional application is hereby also vacated.

All connected application, if any, is also disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Subhendu Samanta, J.)
