The petitioner is directed to serve copy of the revisional application upon Ms. Manisha Sharma, learned advocate who ordinarily appears on behalf of the State. Her appointment be regularised by the concerned authorities. Learned advocate appearing for the petitioner submits that there was misunderstanding and as such the petitioner could not appear. He may be granted an opportunity to appear before the Court.

Having considered the undertaking given by the learned advocate for the petitioner I direct that the learned Trial Court/Special Court if it finds that the petitioner was earlier on bail he may be allowed to continue on bail subject to the condition that he may be restricted within the jurisdiction of Chanchal P.S. and without any permission from the learned

Special Court, the petitioner shall not leave the jurisdiction and make himself available on each date fixed by the learned Trial Court. The warrant of arrest was issued. The next date fixed for trial is on 31st October, 2023. The petitioner shall appear and comply with the directions.

Learned Special Court is granted liberty to release the petitioner on the aforesaid directions or on additional conditions that the learned Special Court may think fit and proper to exercise his discretion.

In case the petitioner do not appear by 31st October, 2023, on or after 1st November, 2023, the learned Trial Court would be at liberty to exercise his powers under Section 82 of the Code of Criminal Procedure.

With the aforesaid observation CRR 3708 of 2023 is disposed of.

All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
