CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 3095 of 2012 In the matter of : Shyam Sundar Mette & Ors. ....petitioners. In Re : An application under Sections 401 and 482 of the Code of Criminal Procedure.

The revisional application was preferred against the order dated 11.08.2006 passed by the learned Additional Chief Judicial Magistrate, Uluberia as also the order date 06.02.2007 passed by the learned 2nd Judicial Magistrate, Uluberia in Complaint case No. 338C of 2006.

The petitioners approached this court immediately after the summons were issued by the learned Judicial Magistrate.

The record of this revisional application reflects that the matter appeared on 05.09.2012 before a co-ordinate Bench of this court and an adjournment was sought for. Having regard to the stage at which the petitioner approached this court and no information being furnished before this court regarding the subsequent progress of the proceedings before the learned court below, I am of the view that an interference is bound to prejudice the course of the

proceedings in the Magistrate's court below where the dates were fixed for evidence before charge in the year 2009. Consequently, no interference is required by this court at this stage.

Accordingly, the present revisional application being CRR 3095 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
