The State of West Bengal

1. Parties are not represented today.

2. This revisional application has been preferred by the revisionist challenging the judgment and order dated 29.6.2012 passed by the learned Additional Sessions Judge, 7th Court, Barasat, North 24 Parganas in Criminal Appeal no. 3 of 2005 whereby and whereunder the judgment of conviction and order of sentence dated 20th May, 2005 of the present revisionist as passed by the learned Judicial Magistrate, 7th Court, Barasat in GRE case no. 180 of 1977 under Section 7(1)(a)(2) of the Essential Commodities Act has been affirmed by the said appellate court. A report has come from the Superintendent of Police, Barasat Police District that the revisionist/convict has died on 18.9.2015. The legal heirs of the revisionist/convict have not approached before this court to continue with the instant revisional application.

3. In view of such, the instant criminal revision being CRR 3098 of 2012 stood abated and is thus disposed of.

4. The department is directed to forward a copy of this order along with lower court record to the learned Trial Court forthwith. A copy of this order be also forwarded to the learned first appellate court for his information. (Partha Sarathi Sen, J.)
