And In Re : Jatin Mehta ..... petitioner Mr. Manoj Kurmi ... for the petitioner Mr. S. G. Mukherji, learned PP Mr. Rudradipta Nandy, learned APP Md. Anwar Hossain Ms. Debjani Saha ... for the State Learned Counsel appearing for the petitioner submits he is in custody for 151 days. It is also contended that he was not placed in test identification parade and has been falsely implicated.
Learned Public Prosecutor opposes the prayer for bail and submits stolen article i.e. pendent of the deceased was recovered from the petitioner.
We have considered the materials on record. Stolen article i.e. pendant of the deceased was recovered from the petitioner. Co-accuseds were identified in the course of test identification parade.
In view of the incriminating evidence and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
The application for bail is, thus, rejected.
