Report submitted by the State is taken on record. The petitioner claims to be the lessee in respect of the plot in question which belongs to the West Bengal Small Industries Development Corporation Limited. The petitioner alleges that the private respondents who are her brother in law and his sons have taken forcible possession of the leased premises a few years back and have stolen all the valuables from the shop run by her.
Opposing the same, learned counsel for the private respondents submits that the petitioner transferred proprietorship of the business in favour of the private respondents in 2018 for a consideration of Rs.1,75,000/-. The petitioner woke up from slumber in 2025 and lodged a false and frivolous complaint before the police. Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that in the event the petitioner is aggrieved by the fact of the police remaining silent in respect of her complaint, she is at liberty to take recourse of Section 175 of the BNSS.
However, the police authority is directed to keep strict vigil over the area so that no untoward incident takes place and to ensure maintenance of peace and tranquility therein.
With the aforesaid observation and directions, the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
