By an order dated August 22, 2023, the Hon'ble DL-52 wt53 wt54 wt55 wt56 wt57 wt58 wt 59 wt60 wt61 wt62 wt 63 12.12.2023 Court No.5 (AD) Supreme Court was pleased to condone the delay in preferring the appeal and directed the High Court to consider the appeal on its merits in accordance with law

after providing opportunity of hearing to the parties before it.

By such order, the High Court was requested to take up the appeals out of turn and dispose of the appeals as expeditiously as possible.

The appeals were mentioned before us in the month of December 2023 only. We directed the matters to be placed in the list immediately on mentioning. Today, learned Advocate appearing for the appellants submits that paper books are yet to be filed. He seeks directions for doing so.

In such circumstances, appellants will file informal paper book incorporating all the papers used before the learned Trial Court.

Let such paper book be filed within two weeks as prayed for.

List all the appeals in the monthly list of January, 2024.

In view of the order of the Hon'ble Supreme Court, the appeals are admitted.

The appellants are directed to put in requisites, namely, postal costs, written up notice forms and correct postal address of the respondents for effecting service of notice of appeal by registered post with acknowledgement due within a week from date.

In the event, the same is complied with, department is directed to effect service immediately.

Department is directed to bring trial court records forthwith.

After arrival of the trial court records, department shall examine the same and if found complete, shall issue a notice under Rule 12 of Chapter IX of the Appellate Side Rules on the learned Advocate of the appellants. Appellants are directed to prepare and file requisite number of informal paper books - printed, type written or cyclostyled, as the case may be - out of Court, within a period of two weeks from date.

Department shall immediately serve a copy of the paper book upon the learned Advocate for the respondents.

After effecting service of notice of appeal upon the respondents, department shall put a note that the appeal is ready as regards service.
