The present revisional application was preferred against judgment dated 27.06.2012 passed by the learned Additional Chief Judicial Magistrate, Barrackpore, North 24Parganas, in M. Case no. 453 of 2011 (T.R. no. 216 of 2011) under Section 125 of the Code of Criminal Proceeding. The order dated 27.06.2012 reflected that the learned ACJM, Barrackpore on an appreciation of the evidence so placed by both the parties was pleased to come to a finding that the applicant/wife was entitled to receive maintenance and accordingly allowed the application under Section 125 of the Cr.P.C. awarding a sum of Rs.3,000/- per month to be paid to the wife from the date of filing of the case. By the same order the learned Magistrate was pleased to allow the husband to liquidate the arrears in thirty equal instalments.
Having regard to the order passed by the learned Magistrate which was based on cogent reasoning, I am of the view that no interference is called for at this belated stage.
Accordingly, CRR 3120 of 2012 is dismissed.
Pending application, if any, consequently disposed of. Interim order, if any, is hereby vacated.
