(M) 1805 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Posta Police Station Case No. 376 of 2015 dated 18.12.2015 under Sections 302/393/394/460/34 of the Indian Penal Code.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 10 years. Learned advocate appearing for the State, on the other hand, submits that cross-examination of the investigating officer is in progress and on majority of dates, time is being prayed for and adjourned on the grounds of the accused. It has been informed that next date is fixed on 21.11.2025. Learned Trial Court, within a period of 15 days from the next date so fixed, would complete the crossexamination of the investigating officer and thereafter proceed under Section 313 of the Code of Criminal Procedure. If the defence proposes to adduce any witness, 30 days' time be granted or in the alternative arguments commenced at the earliest so that verdict may be

pronounced by 15.02.2026. The evidence of the case would proceed in spite of any resolution of the local Bar. Having considered the stage of the case, I am not inclined to consider the prayer for bail. Accordingly, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 1805 of 2025, is, thus, disposed of.
