Mr. Ayan Basu, Mr. Amit Roy, Mr. Sumit Routh, .....for the Petitioners Mr. Bidyut Kr. Roy, Mr. Pratick Bose, .....for the State The petitioners are aggrieved amongst others in respect of warrant of arrest, which has been issued by the Learned ACJM, Islampur, Uttar Dinajpur.
Learned advocate appearing for the petitioners submits that in course of investigation, it appeared to the Investigating Officer of the case that provision under Section 304 of the IPC are to be incorporated. On the same being incorporated prayer for cancellation of bail of the present petitioners were advanced before learned ACJM. Learned advocate submits that sureties were notified by the learned ACJM and they appeared before the Court, in spite of the same the application for cancellation of bail was not heard but subsequently they were absent and warrant of arrest was issued.
In view of the limited grievance expressed by the petitioners, I direct them to serve copy of the revisional application upon Mr. Roy, learned advocate, who ordinarily appears for the
State, he is directed to appear in this matter and represent the State. His appointment may be regularized by the concerned authority.
Having regard to the contentions advanced by the petitioners, I direct that the application for cancellation of bail may be disposed of by the learned ACJM, Islampur, Uttar Dinajpur by November 30, 2022.
Warrant of arrest, so issued, is stayed till that date provided all the petitioners appear on each and every date fixed by the Learned ACJM Islampur, Uttar Dinajpur for hearing of the application for cancellation of bail.
With the aforesaid observations, CRR 3904 of 2022 is disposed of.
Pending applications, if any, are disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
