07.11.2022 sdas rejected C.R.M.(DB) No. 3701 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hemtabad Police Station Case No. 202 of 2019 dated 12.10.2019 under Sections 498A/302/201/34 of the Indian Penal Code.

..... petitioner Mr. Asis Bhattacharyya ... for the petitioner Mr. Binay Panda Ms. Puspita Saha ... for the State Learned Counsel appearing for the petitioner submits he is in custody for more than six years. It is also submitted that there is slow progress in the matter before the trial court. Coaccused has been enlarged on bail. Learned Public Prosecutor opposes the prayer for bail and submits trial is in progress.

We have considered the materials on record. There is ample evidence connecting the petitioner with the murder. Coaccused, who is a lady, has been released on bail. Keeping in mind the aforesaid circumstances and as trial is in progress, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date without granting any unnecessary adjournment to either of the parties.
