Petitioner prays for bail.

The Police filed charge-sheet, inter alia, under Section 304B of the Indian Penal Code after conducting an investigation, inter alia, under Section 302 of the Indian Penal Code. The petitioner is in custody for 130 days. All other coaccused persons were enlarged on bail. Considering the period of detention of the petitioner and considering that Police filed charge-sheet and considering the fact all other co-accused persons are on bail, we grant bail to the petitioner.

Accordingly, the petitioner, viz., Saharuk Mondal @ Saharukh Mondal @ Sharuk Mondal, be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kalyani, subject to the condition that he shall appear before the trial Court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner while on bail shall remain within the jurisdiction of Haringhata Police Station except for the purpose of investigation and/or attending Court proceeding and report to the Officer-in-Charge of Haringhata Police Station once in a week until further orders. In the event the petitioner fails to comply with the conditions as enshrined hereinbefore, the trial Court shall be at liberty to cancel the bail of the petitioner in accordance with law without further reference to this Court.

The application for bail being CRM (DB) 3703 of 2022 is, thus, allowed and disposed of.
